Civil legal issues are incredibly prevalent in everyday life and can have devastating consequences. Yet few individuals obtain the assistance of a lawyer in addressing these issues. Legal technology is seen by many as holding great promise for enhancing individuals’ ability to address their own legal needs, with estate planning frequently offered as a prime example. Yet despite these optimistic assessments, we have limited empirical evidence of the use of legal technology and several bases for skepticism of its reach and efficacy. In this presentation, I will draw on novel survey data regarding the use of legal technology to access estate planning to consider the potential—and the pitfalls—of legal technology to expand access to justice.
