L’evoluzione storica delle ODR: dall’Emoticon ai sistemi Fair Division

Thanks to technological evolution, law is undergoing numerous changes. This article examines the origin of online alternative dispute resolution (ADR) systems, starting from the early 1960s when legal disputes were extremely limited, and the use of a simple emoticon could suffice to prevent conflicts. It then progresses to advanced ODR (online dispute resolution) systems, which, through the use of sophisticated algorithms, ensure the full satisfaction of the parties by balancing compliance with regulations and the concrete interests of the parties. In the second part of the paper, seven types of ODR, among the most efficient and active in the market, will be analyzed, highlighting their main features and resolution methods. Finally, the CREA project, which aims to introduce new dispute resolution mechanisms for lawyers, mediators, and judges to ensure fair distribution among the parties involved in a dispute and to reach an agreement, will be examined.
